Privacy Policy

This policy explains what personal information Surfside Charters collects when you visit sailingcayman.com, make an enquiry or book a charter, how we use it, and the choices you have. Questions about it can go to charters@surfside.ky or +1 (345) 516-7873.

Who We Are

Surfside Charters is a private boat charter company based in Grand Cayman, Cayman Islands, operated by Surfside Watersports Ltd. Surfside Watersports Ltd. is responsible for the personal information described in this policy (in data protection terms, the “data controller”).

What We Collect

  • Enquiries: your name, email address, phone number, preferred date, boat, number of guests and anything you tell us in your message, whether you use our contact form, email, phone or social media.
  • Bookings: the details needed to book and run your charter, such as the lead guest’s name and contact details, the date, trip and group size, and any catering, dietary or accessibility requests. Online bookings and payments are handled by our booking provider, Peek; card details are processed by Peek and its payment processors, and we do not store full card numbers on this website.
  • Waivers: the information on the release and waiver of liability that each guest signs before boarding, including names and signatures, and any health or medical information you choose to share so we can keep you safe on board.
  • Website use: when you visit the site, information such as your device and browser type, pages viewed and how you arrived (for example, from a Google advert), collected through cookies as described below.

How We Use Your Information

  • To answer your enquiries and send quotes.
  • To take and manage your booking, payments, deposits, balances and any changes or cancellations under our booking policy.
  • To run your charter safely, including waivers, weather updates and arranging catering you have asked for.
  • To measure how our advertising performs, where you have agreed to this (see Cookies below).
  • To meet our legal, accounting and insurance obligations.

We do not sell your personal information, and we only send marketing emails if you ask us to.

Who We Share It With

  • Peek, our online booking and payment provider.
  • Catering partners, when you order catering through us: only what they need, such as the date, number of guests and dietary requirements.
  • Google, for advertising measurement through the Google tag, where you have agreed to it.
  • Our insurers, professional advisers and the authorities, where required by law or to deal with an incident or claim.

Some of these providers store information outside the Cayman Islands, including in the United States. We only use providers that protect personal information appropriately.

Cookies and Advertising

Cookies are small files stored by your browser. This site uses:

  • Essential cookies: needed for the site and the Peek booking window to work, for example to keep your booking details as you move through checkout.
  • Advertising measurement: the Google tag, which tells us when someone who clicked one of our Google adverts calls us, emails us or starts a booking, so we can see which adverts work.

If you are in the United Kingdom, the European Economic Area or Switzerland, advertising cookies stay off unless you accept them. Visitors elsewhere can switch them off at any time. You can change your choice whenever you like using the Cookie Settings link at the bottom of every page, and you can also block or delete cookies in your browser settings.

How Long We Keep It

We keep enquiries for as long as we need to deal with them and any follow-up booking. We keep booking, payment and waiver records for as long as needed for the charter and to meet our legal, accounting and insurance requirements, after which we delete them securely.

Your Rights

Under the Cayman Islands Data Protection Act, and the UK or EU data protection rules where they apply to you, you can ask us:

  • for a copy of the personal information we hold about you;
  • to correct anything that is wrong;
  • to delete your information, where we no longer need it;
  • to stop using your information for a particular purpose, including advertising measurement.

Email charters@surfside.ky and we will respond within 30 days. If you are not happy with our response, you can complain to the Ombudsman of the Cayman Islands, which supervises data protection in the Cayman Islands, or to the data protection authority where you live.

Children

Bookings are made by adults. Information about children on a charter, such as names and ages for the waiver, is provided by their parent or guardian.
